2009-01-16-Meeting with Our Lawyers of the Day -Andreu + Alenda

Meeting with Rosario, Abogado, 16th January 2009
Present: Mo Taunton & Peter Hopkins

·        We informed Rosario of our suspension of Apyme, and their removal of their monthly fee, including €7 for tax. Rosario informed us that they pay the tax to the hacienda, and they then have it refunded at the end of the financial year. 

W We asked Rosario whether she knew of a good lawyer specialising in debt collection, she said that she can deal with debt collection, and we are able to do certificates with her. She told us that Apyme was doing a Public Certificate, and we can do a Private Certificate.

·         We showed her of the copies of letters we received from Paco, at our last meeting. One was a letter, to be signed by the President, saying we will accept all the receipts. We informed Rosario that we wouldn’t sign. The second was a letter saying that we would pay the Juan Lavado pending bill. She told us not to sign either bill. letter
       
    We asked in reference to the hacienda, and she confirmed our understanding that no business in Spain can produce a hand written receipt with no Justifcante confirming the payment, contrary to the information given by the other side.

·         She asked about residents contact information, and said we must keep records updated. This would help with court cases and with the Guardia Civil.

·         We asked about all the pending court cases. She informed us of two up-coming cases, 29/01/09 – Gregory & 31/03/09 – K. Shorecliff.
T. Russell – Unable to present paperwork. Need to present paperwork a.s.a.p.      Otherwise the courts will archive the case.
T. Morris – We are waiting for the Judgment
M. Rouse – Unable to present paperwork, but found an address in Crevillente.
B. Parker – As B. Parker has died, we need to know the new owner of the plot, see if they are willing to pay.
Peñalver – Has paid the courts, we are now waiting for the money to be released.
Remedia – Awaiting the Judgement from the courts in Elche
.
·         Rosario was pleased to return to us in cash €998.37, the payment from  J. Muñoz, Muñoz Cano, through the courts.

·         We informed Rosario of our meeting with Clara, and a possible resolution. She informed us that she has paid up to 2005 to the courts.

·         Rosario asked if we have the 2008 debtors list. We need to have them done by the 31st December each year.
